Expert witness selection is critical to the medical legal process and can be chunked into two phases:

Phase 1 - Expert Identification Process 

Phase 2 - Trial Preparation & post trial 

 

Phase 1 - Expert Identification Process

1) START EARLY

Early identification can provide an advantage to lock in experts that aligns with the strategy.  

2) FIND THE RIGHT EXPERT

There are many tools and services that can assist to locate the right expert.  Referrals and recommendations can provide better insights into the capabilities of the expert. 

3) SCREENING

Make sure that there are no other potential conflicts. Consider confidentiality agreements to cover shared information.  

4) IMPARTIALITY

Expert should offer unbiased opinions based on the merits of the facts and information available and not someone who will say and do anything for compensation. Legitimate and highly qualified experts are distinctive and can be differentiated with those who provide opinions in support of their paying client.
